1. Introduction & Safe Harbor Status
Smarter 8K IPTV ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement.
Important Disclaimer: Smarter 8K IPTV functions purely as an online indexer and search engine for media available on the internet. We do not host, store, archive, or distribute any media files (videos, movies, live streams) on our own servers. All video content is hosted by non-affiliated third parties. Therefore, while we can remove links from our index, we cannot delete the actual media files from the servers where they are hosted.
2. Notification of Copyright Infringement
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through our website and service by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of a valid Notice as described below, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged links or content from our service.
3. Required Elements of a DMCA Notice
To be effective, your notification must be in writing and include the following elements (pursuant to 17 U.S.C. § 512(c)(3)):
- 1. Physical or Electronic Signature: The signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- 2. Identification of the Copyrighted Work: Identify the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- 3. Identification of the Material: Identify the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. (You must provide exact M3U links, URLs, or specific channel/VOD names as they appear on our platform so we can locate them.)
- 4. Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.
- 5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- 6. Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
4. Counter-Notification Procedure
If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent. The counter-notice must contain the following:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the U.S., any judicial district in which Smarter 8K IPTV may be found), and that you will accept service of process from the person who provided the original notification.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Smarter 8K IPTV has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users, subscribers, or account holders who are deemed to be repeat infringers of intellectual property rights. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Designated Copyright Agent
All DMCA notices and counter-notices must be sent directly to our Designated Copyright Agent via email. Please allow up to 48 hours for a response and for action to be taken on valid requests.
